These Terms explain the rules for using the Pigisakka website and for submitting education enquiries and registrations with Pigisakka B.V.

These Terms of Service (“Terms”) are a legal agreement between you and Pigisakka B.V. (“Pigisakka”, “we”, “us”), with its registered address at Gebroken Meeldijk 45, 2991 VB Barendrecht, Netherlands. If you do not agree to these Terms, do not use this website.

Participation in educational programs does not guarantee employment, promotions, certifications, salary increases, business success, or financial outcomes. 9. Limitation of liability

To the maximum extent permitted by law, Pigisakka B.V. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the website or educational materials, even if we have been advised of the possibility of such damages.

To the extent liability cannot be excluded, our total liability for all claims arising out of or relating to the website will be limited to the greater of (a) the amount paid by you to us in the 12 months before the event giving rise to the claim, or (b) €100.

Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, or any liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless Pigisakka B.V., its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to (a) your use of the website, (b) information you submit through forms, (c) your violation of these Terms, or (d) your violation of any applicable law or third-party rights.

11. Force majeure

We will not be liable for delays or failures in performance resulting from events outside our reasonable control, including natural disasters, war, terrorism, labour disputes, pandemics, internet outages, cyberattacks, hosting or cloud provider failures, or government actions.

12. International use

Pigisakka B.V. is established in the Netherlands and provides online educational services to learners across Canada. Accessing the website from other locations is done at your own initiative, and you are responsible for compliance with local laws to the extent applicable.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to conflict of laws rules. Any dispute arising out of or relating to these Terms or the website will be submitted to the competent courts in Rotterdam, the Netherlands, unless mandatory consumer protection rules require otherwise.

If you are a consumer resident in the European Union, you may also have rights under mandatory provisions of your local consumer protection laws that cannot be waived.
